CAN YOUR LEGALLY PRESCRIBED MEDICATIONS PREVENT YOU FROM GETTING DRIVING PRIVILEGES IN FLINT MICHIGAN RESTORED??

In a word "yes", and anywhere else for that matter but for the most part prescription medications will not present a problem. Michigan DAAD hearing officers are not going to be concerned about medications for high blood pressure or cholesterol. Nor will antibiotics pose a problem. What MAY be of concern to someone are the scripts for Oxycontin, Oxycodone, Dilaudid, Vicodin even Xanax, etc...

If it impairs your ability to drive safely then it is going to be a big problem for the hearing officer.

For many people however, taking the above mentioned types of drugs does not impair their ability to drive safely. For those who do become impaired, the mere fact that they have a valid prescription to take a controlled substance will not exonerate them. If you get pulled over and present to the officer a valid prescription, it will have no exculpatory effect. He will not just let you go. You will first be required to exit the car and participate in, and pass, "field sobriety" tests. If you fail these tests, you most likely will be cited for OUID (operating under the influence of drugs).

Whatever concerns the police officer has with respect to keeping people safe on the road will be echoed by the DAAD hearing officer. Safety of Michigan drivers is his/her primary concern.

Our mission, when confronted with a petitioner who has these types of challenges is to get the prescribing Dr. involved. It is the ONLY way. Once we get the appropriate reassurances of the treating physician to the hearing officer our odds of reinstatement improve dramatically.
