Misdemeanor Marijuana Charges In Michigan

Were you aware that in Michigan there are different penalties for misdemeanor marihuana charges depending on who the arresting agency is? That's right, if you happen to get pulled over by a State Trooper or County Sheriff , your penalties are going to be different than if your run-in is with a local city, township or village police officer (eg. Flint, Burton, Grand Blanc, etc...).

If a County Sheriff or State Trooper arrests you for misdemeanor use or posession of marihuana your penalties will be controlled by State Law. On the other hand, if the arresting agency is a local city, township or village police officer then your matter will fall under a "local ordinance" if one exists.

Under State Law, possession of marihuana is a misdemeanor. It is punishable by up to one year in jail and/or a fine of not more than $2,000.00 dollars.

Under a "local ordinance" you would still be guilty of a misdemeanor however the crime is punishable by 93 days in jail and/or a fine of not more than $500.00.

The other penalties are in the nature of license suspension. The Judge under both State Law and local ordinance must suspend driving privileges for a period of six months where no driving is allowed for the first 30 days-period. Thereafter, the Judge may grant restricted privileges for the balance of the six months. These restricted privileges allow you to drive back and forth to work and during the course of your employment (if your job requires it), to doctors appointments, counseling and various other activities. After the six month period expires, full privileges are automatically restored.

The penalties which I have outlined above apply to first time offenders. All jail time, fines and driving restrictions for second time and subsequent offenses are enhanced.
